The primary purpose of the bill (Reg. No. 8024) is to improve the mechanism of implementation of the ban on gambling in Ukraine. Under the bill, "gambling business is the activity connected with organization, holding and provision of access to gamble in casinos, at gambling machines and computer simulators, in betting offices, interactive facilities, and cyber casinos regardless of the server location." According to the bill, "gamble is any game, participation in which presupposes obligatory payment of money by a gambler, which gives a possibility to enter stakes in any form and receive a prize of any type, the result of which fully or partially depends on fortuity."
The Committee concluded that the bill complies with the European Union laws.
However, the peculiarities of licensing in economic activity in the sphere of gambling in the European Union are regulated on the level of domestic law of member countries.
The Committee also stated that the principles of the bill meet clauses 43-55 of the Treaty on the European Union that envisages the right to set up and perform a business and decisions of the European Court in number of cases.
Thus, the European Court grants vast scope of liberties to choose means to protect the society from the negative consequences of gambling and gaming business, defining necessity and proportionality of the national norms.
The Committee is convinced that "Ukraine has the freedom to choose means and methods to regulate services connected with establishments of gambling and gaming business in Ukraine."
